Pilate v. Davis

Opinion of the Court

PER CURIAM.

We affirm the trial judge in all particulars in this case with the following exceptions:

1. The $250.00 setoff granted to the appellees is reversed because it is unsupported by the evidence.

2. The trial court erred in not awarding Nathaniel Pilate, the plaintiff below, prejudgment interest on his net award.

AFFIRMED IN PART; REVERSED IN PART; AND REMANDED FOR FURTHER PROCEEDINGS CONSISTENT WITH THIS OPINION.

COBB, W. SHARP, and GRIFFIN, JJ., concur.
