PER CURIAM.

On the authority of Palmer v. State, 775 So.2d 404 (Fla. 4th DCA 2000), we (1) treat this petition for writ of mandamus as one for certiorari, (2) grant the petition, and, (3) remand for attorney Alan Levine to file his notice of appearance. If the state challenges the propriety of the representation, *1270a judge other than Judge Goldstein shall rule on the issues raised by the state.
