PER CURIAM.

We elect to treat appellee’s motion for remand or to relinquish jurisdiction as a confession of error. The trial court’s order denying appellant’s motion for relief is *1005hereby reversed and the cause is remanded for further proceedings.

REVERSED AND REMANDED.
