Goodell v. State

Goodell v. State
Florida District Courts of Appeal · Decided February 14, 2001 · Allen, Barfield, Browning
776 So. 2d 1132; 2001 Fla. App. LEXIS 1358 (Southern Reporter, Second Series)

Goodell v. State

Opinion of the Court

BARFIELD, C.J.

The parties agree that the sentence on the charge of home invasion robbery is valid and that the sentence on each of the other five charges exceeds the statutory maximum due solely to the ten-year probationary term added to the statutory maximum prison term. We STRIKE the probationary term from the five challenged sentences, and AFFIRM the sentences in all other respects.

ALLEN and BROWNING, JJ., concur.
