I must affirm by virtue of this court’s majority denial of the motion for rehearing en banc of Woodham v. Blue Cross & Blue *1148Shield of Florida, Inc., 793 So.2d 41 (Fla. 3d DCA 2001), but I would have granted rehearing in that decision.
