State v. Morello
Florida District Courts of Appeal · Decided January 16, 2002 · Farmer, Gross, Warner
805 So. 2d 75; 2002 Fla. App. LEXIS 216; 2002 WL 54438 (Southern Reporter, Second Series)

State v. Morello

Opinion of the Court

PER CURIAM.

We affirm the order granting appellee’s motion to suppress. The court concluded, and we agree, that the police officer did not have probable cause to believe that appellee was committing a violation of the traffic laws. See Holland v. State, 696 So.2d 757, 759 (Fla. 1997) (probable cause *76that a traffic violation has occurred makes stop reasonable).

WARNER, FARMER and GROSS, JJ., concur.
