On Confession of Error

Upon consideration of the appellee’s response and statement of error filed February 7, 2011, the final summary judgment of foreclosure and the order denying motion for rehearing are reversed; this case is remanded for further proceedings including, but not limited to, amendments to the *632parties’ pleadings and a re-filing of any motions by the parties thereafter.

Reversed and remanded.
