Coffie v. State
Florida District Courts of Appeal · Decided March 11, 2011 · Evander, Jacobus, Lawson
56 So. 3d 136; 2011 Fla. App. LEXIS 3267; 2011 WL 830552 (Southern Reporter, Third Series)

Coffie v. State

Opinion of the Court

PER CURIAM.

Byron Coffie raises the issue of ineffective assistance of trial counsel in this direct appeal. Generally, ineffective assistance of counsel is not a cognizable claim on direct appeal. See Blanco v. Wainwright, 507 So.2d 1377 (Fla. 1987). Therefore, the judgment and sentence are affirmed without prejudice to the appellant to raise the issue by way of a timely motion filed pursuant to Florida Rule of Criminal Procedure 3.850.

AFFIRMED.

LAWSON, EVANDER and JACOBUS, JJ., concur.
