Leif v. State

Opinion of the Court

PER CURIAM.

The State concedes that the record does not conclusively refute petitioner’s legally sufficient postconviction claims and that reversal is required. Fla. R.Crim. P. 3.850(d). We reverse and remand for further proceedings and an evidentiary hearing if necessary.

MAY, C.J., CIKLIN and CONNER, JJ., concur.
