Defendants. ____________________________________/ ORDER Defendants move to dismiss Plaintiffs’ First Amended Complaint and strike Plaintiffs’ claim for punitive and treble damages. (Doc. 20.) The Magistrate Judge issued a report recommending that the Court grant Defendants’ motion. (Doc. 74.) Upon the Plaintiffs’ request, the Court extended the fourteen-day deadline to file objections to the Report & Recommendation, yet no timely objections were filed. (Doc. 76.) After a de novo review, the Court concludes that the motion should be granted for the reasons stated in the Magistrate Judge’s Report. (Doc. 74.) The Court concludes, though, that because sovereign immunity under the Eleventh Amendment bars Plaintiffs’ claims, dismissal without prejudice is appropriate because the Court essentially lacks subject matter jurisdiction. ,
