The Commissioner seeks a remand in order for “the Commissioner, through the Appeals Council, [to] refer [the] Plaintiff’s case to an Administrative Law Judge” (ALJ), who shall, in turn, “offer [the] Plaintiff an opportunity for a new hearing, take any further action necessary to complete the administrative record, and issue a new decision.” Id. Mr. Dudek became the Acting Commissioner of Social Security on February 16, 2025. Pursuant to Federal Rule of Civil Procedure 25(d), Mr. Dudek is substituted for the former Acting Commissioner, Michelle King, as the Defendant in this suit.
