Upon consideration of motion to consolidate, said motion is denied and the petition filed herein is dismissed as being moot since the Court has granted certiorari in Post v. Lunney, case no. 41,077 based on the certificate of the District Court of Appeal dated May 18, 1971, 248 So.2d 504.
