Supreme Court of Florida · Decided September 28, 1978 · Adkins, Alderman, Boyd, England, Hatchett, Overton, Sundberg

State v. Thomas

Opinion of the Court

PER CURIAM.

The order of the trial court, granting the motion to dismiss on the ground that Section 812.014, Florida Statutes (1977), is unconstitutional, is reversed. See State v. Allen, 362 So.2d 10 (Fla. 1978). This case is remanded to the trial court for proceedings consistent with that decision.

It is so ordered.

ENGLAND, C. J., and ADKINS, BOYD, OVERTON, SUNDBERG, HATCHETT and ALDERMAN, JJ., concur.
