Opinion of the Court

PER CURIAM.

Since we find material issues of fact bearing on the existence of “probable cause,” the decision of the First District Court of Appeal, 360 So.2d 1251, is quashed and the case remanded to the trial court. City of Pensacola v. Owens, - So.2d -, No. 53,795 (Fla. Feb. 1, 1979).
