PER CURIAM.

Because we find the constitutional issue to be frivolous, this case is transferred to the Circuit Court for the Eleventh Judicial Circuit. First Amendment Foundation of Florida, Inc. v. State, 364 So.2d 450 (Fla. 1978).

It is so ordered.
