This case is controlled by the decision in Ward v. Ward (No. 10979), ante, 695. There are some assignments of error in this case which were not raised in that case, but, as they are not referred to in the brief of counsel for the plaintiff in error, they are treated as abandoned.

Judgment affirmed.
