Buckner v. State

Buckner v. State
Georgia Court of Appeals · Decided July 29, 1925 · Bboyles
34 Ga. App. 238; 129 S.E. 5; 1925 Ga. App. LEXIS 189

Buckner v. State

Opinion of the Court

Bboyles, C. J.

The defendant was convicted of the offense of car-breaking. The evidence tending to connect him with the crime was wholly circumstantial and was insufficient to exclude every reasonable hypothesis save that of his guilt. The court, therefore, erred in overruling the motion for a new trial.

Judgment reversed.

Luke and Bloodworth, JJ., concur.
