Jacobs v. State

Opinion of the Court

Bloodworth, J.

The evidence in this case was entirely circumstantial and did not exclude every reasonable hypothesis save that of the guilt of the accused, and the court erred in overruling the motion for' a new trial.

Judgment reversed.

Broyles, O. J., and Luke, J., concur. J. R. Hutcheson, for plaintiff in error, cited: Wilson T. State, 32 Ga. App. 427. S. W. Ragsdale, solicitor-general, contra.
