Where a case is nonsuited, a motion for a new trial is not the proper mode of testing the correctness of that judgment; and the court in the instant case properly dismissed the motion. Smith v. Perryman, 38 Ga. App. 496 (1) (144 S. E. 341), and cases cited.

Judgment affirmed.
