Georgia Court of Appeals, 1933

Horton v. State

Horton v. State
Georgia Court of Appeals · Decided January 25, 1933 · Broyles, Guerry, MacIntyre
46 Ga. App. 315; 167 S.E. 606; 1933 Ga. App. LEXIS 41

Horton v. State

Opinion of the Court

Broyles, O. J.

The evidence connecting the defendant with the offense charged was wholly circumstantial and was not sufficient to exclude every reasonable hypothesis except that of his guilt. It follows that his conviction was unauthorized, and that the overruling of his motion for a new trial was error.

Judgment reversed.

MacIntyre and Guerry, JJ., concur.
