Watts v. State
8 S.E.2d 714; 62 Ga. App. 504; 1940 Ga. App. LEXIS 319
(South Eastern Reporter, Second Series)
Watts v. State
Opinion of the Court
The evidence tending to connect the accused with the offense charged (possessing whisky) was wholly circumstantial, and was insufficient to exclude every reasonable hypothesis save that of his guilt. Itβ follows that the refusal of the court to grant a new trial was error.
Judgment reversed.
