108 Ga. 766; 33 S.E. 421; 1899 Ga. LEXIS 369

Skinner v. Town of Douglasville

Opinion of the Court

Little, J.

Ifc was, on the trial of an action against a municipal corporation for personal injuries alleged to have been occasioned by a defect in a street, erroneous to direct a verdict for the defendant, when there was evidence from which the jury might have found that it was negligent, and that at the time of receiving the injuries the plaintiff was exercising ordinary care and diligence.

Judgment reversed.

All the Justices concurring.
