Upon consideration of the "Notice of Larry Card's Withdrawal of Appeal Due to Severe Health Problems" filed on January 19, 2022, by self-represented Plaintiff-Appellant Larry Card (Appellant), the record, and there being no opposition, we construe Appellant's notice to be a motion to dismiss the appeal pursuant to Hawai#i Rules of Appellate Procedure Rule 42(b).

Therefore, IT IS HEREBY ORDERED that the motion is granted and the appeal is dismissed.
