Jacobsen- Nice (together, Nice Parties), which the court construes as a motion for reconsideration (Motion for Reconsideration), the papers in support, and the record, IT IS HEREBY ORDERED that the Motion for Reconsideration is denied.

IT IS FURTHER ORDERED that within ten (10) days from the date of this order, the Nice Parties shall pay the filing NOT FOR PUBLICATION IN WEST'S HAWAI I REPORTS AND PACIFIC REPORTER fees in the full amount to the Supreme Court Clerk's Office. 1 Failure to pay the filing fees may result in the appeal being dismissed.
