The dismissal is without prejudice to Seina filing a Hawaiʻi Rules of Penal Procedure Rule (HRPP) petition in the circuit court asserting ineffective assistance of counsel.

Appointment of counsel to represent Seina during the HRPP Rule 40 proceeding may be appropriate.
