3. Master and servant, ยง 44* โ€” when employee may commence action for damages for breach of contract of employment. In an action to recover for breach of a contract of employment, where the employer has breached the contract by repudiating it, the employee has the right to commence an action for such damages as he may have suffered by reason of the breach and repudiation, regardless of the date when the contract by its terms expires.
