Judge Owsley

delivered the opinion of the court.

The principle involved in this case, was settled in the case of Furguson & al. against White,a at this term; and, according to that case, there is no doubt but that the court below decided correctly, in withholding the instructions which were asked by the counsel of the appellant.

The judgment must, therefore, be affirmed, with cost and damages upon the damages.
