Carter v. Kilburn

Opinion of the Court

Judge Owsley

delivered the opinion of the court.

We are of opinion, that upon its being shewn that Carter resided in the county of Lincoln, the court of Pulaski Ought to have dismissed the proceedings had upon a warrant issued from a justice of Pulaski-against him, under the act regulating proceedings in cases of bastardy.

The judgment must be reversed with cost, the cause remanded, and the proceedings dismissed.
