Wilson v. Sanders
Court of Appeals of Kentucky · Decided January 4, 1831 · Robertson
28 Ky. 288; 5 J.J. Marsh. 288; 1831 Ky. LEXIS 9

Wilson v. Sanders

Opinion of the Court

Chief Justice Robertson

delivered the opinion of the court.

Tim case of Norton vs. Sanders, (V J. J. Marshall, 287,) is decisive of this case. The circuit court ought to have heard the evidence for identifying the traverse and bond, and ought, if it had been satisfactory, to have permitted a correction and re-acknowledgment of the bond, and not have dismissed the traverse.

Judgment reversed and cause remanded for further proceedings.
