Gunby, J.

Where an open account has been settled by a note, it is always competent for defendant to enquire into the correctness of the items of the account for which the note was given. But in such cases the burden of proof is on defendant to prove error.

2. Where an ignorant freedman kept the number of days he worked for his employer, by making notches on a stick,' such stick is admissible in evidence to prove the .number of days.
