This is a companion case to that of Dane v. Canal Insurance Company, La. App., 116 So.2d 359. The conclusions reached make it unnecessary that we give consideration to or pass upon defendant’s *363plea to the jurisdiction of the court ratione personae.

For the reasons assigned in the aforesaid case, the judgment appealed is affirmed at appellant’s cost.
