Opinion of the Court

SAVOY, Judge.

This is a companion case to the suit entitled Humble Oil & Refining Company v. Jones, La.App., 125 So.2d 640.

The facts in the case at bar are similar to those in the case of Humble Oil & Refining Company v. Jones, supra, with certain exceptions which are not material in the decision of this case.

For the reasons assigned in the case of Humble Oil & Refining Company v. Jones, the judgment of the district court is affirmed.

Affirmed.
