The facts and issues of this appeal have been discussed in the companion case of Persinger v. Purvis, et al., La.App., 160 So.*332d 27, rendered this same date. For the reasons therein assigned, the judgment appealed from is affirmed, with all costs of this appeal assessed against appellant.

Affirmed.
