Jarvis v. Sharp

Opinion of the Court

BAILES, Judge.

Herein the defendant-appellees filed a motion to dismiss this appeal on the ground that the devolutive appeal bond was not timely filed. Plaintiffs-appellants have filed a motion wherein they consent that this appeal be dismissed. Therefore, inasmuch as the devolutive appeal bond was not timely filed, this court is without appellate jurisdiction and this appeal is dismissed, at plaintiffs-appellants’ costs.

Appeal dismissed.
