TUCKER, Judge.

This case was consolidated with case No. 2909 decided this day, 209 So.2d 311 involving the identical issues raised in this case.

Therefore, for the reasons assigned in case No. 2909 the judgment is reversed in part and affirmed in part as is more fully described in case No. 2909.

Reversed in part and affirmed in part.
