MILLER, Judge.

Plaintiff Jerry Winstead appealed the trial court’s judgment dismissing this suit at his costs. Appellant did not file a brief in this court and failed to appear when the case was called for argument.

The appeal was therefore abandoned and is hereby dismissed at plaintiff’s costs. See Uniform Rules, Courts of Appeal, Rule VII, Section 5(b). Johnson v. Sayes, 231 So.2d 651 (La.App. 3 Cir. 1970).

Appeal dismissed.
