FRUGÉ, Judge.

For the reasons assigned in Brouillette et al. v. State of Louisiana, Through Department of Highways, 275 So.2d 196 (La.App. 3rd Cir., 1973), the judgment in this case is affirmed. All costs of this appeal are assessed to defendant-appellant.

Affirmed.

PER CURIAM.

For the reasons assigned in the denial of the application for rehearing in Brouillette et al. v. State of Louisiana, through Department of Highways, 275 So.2d 196 (La.App. 3rd Cir., 1973), the original opinion in this case is amended to delete the assessment of costs to the Department of Highways. With this amendment, the rehearing is denied.
