SCHOTT, Judge.

This appeal from the trial court’s dismissal of plaintiffs’ suit on the ground of prematurity is an attack on the Louisiana Medical Malpractice Act, LSA-R.S. 40:1299.-41 et seq. on the ground that it is unconstitutional. That question was settled in Everett v. Goldman, 359 So.2d 1256 (La. 1978).

The judgment is affirmed.

AFFIRMED.
