For the reasons given in the companion case hereto, Tucker v. Pinder, 631 So.2d 735 (La.App. 3d Cir. 1994), rendered this date, the judgment of the trial court is affirmed in part, amended in part, and reversed in part.

AFFIRMED IN PART; AMENDED IN PART; AND REVERSED IN PART.
