For the reasons given in the companion case hereto, Tucker v. Pinder, 631 So.2d 735 *742(La.App. 3d Cir. 1994), rendered this date, the judgment of the trial court is affirmed in part, amended in part, and reversed in part.

AFFIRMED IN PART; AMENDED IN PART; AND REVERSED IN PART.
