Succession of Carrier v. Allstate Insurance

Opinion of the Court

FOGG, Judge.

This appeal is taken from the denial of a motion for summary judgment, from which no appeal lies; therefore, we dismiss the instant appeal, ex proprio motu. See LSA-C.C.P. art. 968. We have granted relator’s application for writ of certiorari. See Carrier v. Allstate Ins. Co., docket number 96 CW 2681, 702 So.2d 367 (La.App. 1997) also decided this date.

APPEAL DISMISSED.
