The underlying facts of this appeal are recounted in Rogers v. Horseshoe, 32,800-CA (La.App. 2 Cir. 2000), 766 So.2d 595 also rendered this day.

For the reasons expressed in that opinion, the judgment of the district court is AFFIRMED. Costs of this appeal are assessed to the appellants, Harold and Susan Rogers.

AFFIRMED.
