SULLIVAN, Judge.

For the reasons set forth in the consolidated case of Smith v. Clement, 01-87 (La.App. 3 Cir. 10/03/01); 797 So.2d 151, the judgment of the trial court is affirmed and damages for frivolous appeal are awarded. Costs of this appeal are assessed to Dr. Richard J. Clement and the Patient Compensation Fund.

AFFIRMED; DAMAGES AWARDED FOR FRIVOLOUS APPEAL.
