For the reasons assigned this day in the companion case of Anthony Marquez v. Progressive Ins. Co., et al, 06-1024 (La. App. 3 Cir.12/6/06), 944 So.2d 876, this matter is affirmed. Costs of this appeal are assessed against Plaintiff/Appellant, Anthony Marquez.

AFFIRMED.
