By the Court.

The defendant was arrested and held to bail by the sheriff. An application Was made to the Judge of the first judicial District to discharge him ; the Judge refused. An appeal, or something in the nature of it, from the refusal of the District Judge, is prayed for to this Court.—The Court are of opinion that this is not such a case as will support an appeal! The motion is therefore overruled;
