A motion has been made to dismiss this appeal on several grounds; one of which is, that one of the parties, defendant, who is a parly in interest, has not been cited, or appeared in the appeal. Without this party before us, no judgment can be rendered by this court. The motion must therefore prevail.

The appeal is therefore dismissed, with costs.
