Knox v. Duplantier

Opinion of the Court

Tajdiaperro, J.

A motion is made to dismiss the appeal in this case, on the ground that no appeal bond has been given to any of the parties called in warranty and made defendants. This defect, being apparent from the appeal bond, the motion to dismiss must prevail.

It is therefore ordered that the appeal in this case be dismissed, at costs of the appellants. 12 Rob. 203; 10 An. 232; 14 An. 315.

Rehearing refused.
