Howell, J.

We are not favored with a brief or argument on behalf of the appellant. There is in the record a bill of exceptions to the refusal of the judge a guo to grant a trial by jury on the ground that the suit, being for taxes, is summary and not to be tried by a jury. The ruling of the judge was correct. The law makes this class of cases summary in the mode of proceeding, and such are not to be submitted to juries. C. P. 756-57; 19 An. 82.

Judgment affirmed.
