Bermudez, O. J.

For the reasons assigned in the opinion just delivered in the case of Desmarais vs. Board, No. 1857, in 41 An. 697, it is ordered that the motion to dismiss be overruled, and, on the merits, it is ordered and decreed that the judgment appealed from be annulled, avoided and reversed and that there now be judgment in favor of the defendant, dissolving the injunction and rejecting plaintiff’s demand at his cost in both courts.
