Succession of Theriot

Opinion of the Court

MONROE, J.

The delay for the return of the appeal in this case was extended, but the transcript was not filed in this court until after the return day, and appellee moves to dismiss on that ground. The motion must prevail. Hudson et al. v. Garrett, Sheriff, et al., 47 La. Ann. 1534, 18 South. 510; Building & Loan Ass’n v. Church, 48 La. Ann. 1458, 21 South. 24.

It is therefore adjudged and- decreed that the appeal herein be dismissed, at the costs of the appellants.
